Here's how to remove Public Records from your Credit Reports!

I’ve spent a couple of weeks if not months contemplating if I should write this blog about PUBLIC RECORDS. Not because I want to gatekeep but because of all the false information I’ve seen online, and the reaction of people who have reached out to me asking about public records. They could not believe how tedious the process is, and how misguided they have been by these Instagram gurus.


The time has come where I decided to utilize this long weekend to break down Public Records on your credit reports and how to approach them. So, buckle up!


I usually say Charged Offs are by far the most challenging items to delete from your credit reports, however, Public Records are the worst items to have, such as Bankruptcy, Evictions, and Civil Judgements. Let me break it down on why I think they are the worst.


When you’re ready to obtain new credit-anything where a creditor has to pull your credit- they see a public record, they then automatically see you as a HIGH-RISK Borrower. Why may you ask? Well, not only did the potential borrower was late on paying their bills, but they were also so delinquent that they were taken to court by the company, yet they still did not pay. You see where I’m going with this? Think about it for a second, would you lend someone like that borrower money with that history? I know I wouldn’t! I believe in giving people chances, but what makes me think they would pay me when they still owe people who ALREADY took them to court?


I know this does not sound good and it sounds judgmental! But guess what? That’s how creditors evaluate the credibility of potential borrowers.


Now that I got all that out the way, let me share some GREAT NEWS with you, THE COURTHOUSE IS NOT IN THE BUSINESS OF REPORTING ANYTHING TO THE CREDIT BUREAUS! The Credit Reporting Agencies are privately owned after all!


Let’s dispute them, whether it is a civil judgment, eviction, bankruptcy. Follow the steps below:

1. First, you will dispute the public records with the three credit bureaus, ask them to delete them because they are reporting inaccurate information on your report. (If they come back deleted, it’s a win, and you’re done!)


2. If they come back verified, then now time for the fun part (remember when I said the courthouses do not do business with the credit bureaus?)

a. Call the courthouse where the public records were filed (you can also go there)

b. Ask to speak to someone in the records department

c. Ask them specifically if they report to the credit reporting agencies or subscribe to them. They will tell you they do not. (The credit reporting agencies are privately owned, REMEMBER THAT!)

d. BE SURE TO TAKE DETAILED NOTES-who you spoke to, if they have an employee number, the number you dialed, and the time and date you contacted them.


3. Send the credit bureaus a certified mail letter with a return receipt. BE FIRM, PISSED YET KIND. Ask them for their method of verification because you practically did their jobs for them. Be sure your letter includes all the detailed notes you took in number 2(d), tell them exactly who you spoke to, when, what they said, and demand that they delete the public records promptly for failure to properly investigate accounts they claimed were verified as accurate.


Ask yourself this question loves, Who did they verify it with since the courthouse doesn’t have a subscription with them- they don’t report to them?


If they ignore you and persist on saying that the accounts were verified, which they sometimes do, it is when you start filing complaints with the Government Agencies.


Since you can file complaints with Government Agencies about creditors, credit reporting agencies, and collection agencies, this in fact prove that credit repair is not a scam and/or crime. The credit bureaus, the collection agencies, and the creditors must abide by specific laws. YOU HAVE RIGHTS AND PLEASE TAKE ADVANTAGE OF YOUR RIGHTS!!!

When disputing errors on your reports, be sure to remain ORGANIZED and CONSISTENT. DO NOT GIVE UP! Credit Repair is not a sprint, it's a marathon!
